My Very Unofficial Guide to Georgia Brewing Laws

Disclaimer. Do not assume that I am correct in my interpration of the Georgia Code. I am NOT a lawyer. This is just my opinion.

Georgia has been kind enough to post all of it's laws online as something known as the Georgia Code. It is divided into titles. Title 3 appears to be the section dealing with the production and sales of alcohol within the state. I'm going to go through each chapter of title 3 and attempt to summarize them in plain English. My ultimate goal will be to one day start my own Meadery.

Now, of course the first thing I noticed going through this stuff was neither mead nor honey are ever mentioned. Strike 1. Okay, so I'm going to go forward anyway. You can click on the chapter name to see a break down of the individual sections.

  • Chapter 3-1 - This chapter gives the code its name, defines terms, grandfathers in old liquor licenses, enforces displaying of alcohol warnings, and establishes violations of this code as a misdemeanor
  • Chapter 3-2 - This chapter deals with the powers and duties of the Georgia Revenue Commissioner with regard to the Alcoholic Beverage Code. The take-aways I got were:
    • You have to have a license to sell alcohol
    • You must report your sales every month
    • You must report your on shipping activity every month
    • You will pay taxes - I assume this is extra tax above and beyond your other business taxes
  • Chapter 3-3 - Inn progress - Laws regulating sales and possession of alcohol in Georgia
